Contract, Waiver and Release
I do hereby agree to participate in the Big Island Tony Ramos Kajukenbo (referred to as “Company”) located at 69 Railroad Ave Suite A11, Hilo, Hawaii. The responsible party must read the entire contract before signing.
I recognize the risks of injury that are common to any martial arts, self-defense, fitness, or self myofascial release program that my child or I participate in and I do hereby waive and release the Company from and against any and all claims, actions, causes of action, damages, costs, liabilities, expense of judgments, including attorney’s fees and court costs, that arise out of my participation in this program, and all activities associated with Big Island Tony Ramos Kajukenbo. I hereby execute this Waiver and Release form permitting my minor child and/or myself to participate in the Company’s program.
I understand that the martial arts classes are based on a twelve-month calendar year and that membership fees for the (year’s) school session is based on a twelve-month calendar year. Students will average eight or more classes per month/per calendar year. I understand that one installment for new enrollments (sign-up fees) are due at registration for the first month’s tuition. Membership fees are due each month regardless of Student’s absence, major holidays, and /or school holidays. I understand that I may not receive a courtesy bill reminder. Membership and promotion fees must be current and in good standing to be eligible for any promotion. Membership fees will be due on the 1st of each month and will be collected as follows:
- Members making manual payments will be due on the 1st of each month, with a 10 day grace period. Payments received after the 10th of the month will incur a $15 late fee, with an additional $10 for every 30 days thereafter.
- Members with auto recurring bill pay will be charged on the 10th of each month.
Returned checks will result in a $25.00 penalty fee. Be advised that it is the Student and / or Guardian’s responsibility to make sure payment is received on time. On-Line Bill Pay is the preferred method of receiving payment. All fees are subject to an annual increase due to the cost of living.
I understand that students may not switch classes or make up classes without prior approval and scheduling with the Company’s office. All make up classes shall be posted in the calendar as they become available. If student needs to change their class time due to other sport obligations, or for any other reason, scheduling must be approved and confirmed by the Company’s office. Student membership fees must be in good standing in order to receive make up classes.
I understand that Registration, membership, promotion, equipment, and seminar fees are non-refundable. I understand that if I wish to terminate membership I will provide the Company a 30 day advance written notice on or before the 10th day of the current billing cycle month. Tuition Fees must be paid in full and your account must be in good standing before a Student Termination request will be accepted by the Company and or the Company’s Billing Company. There are no pro-rations or refunds upon registration enrollment excluding the following exceptions. When a new student enrolls during their first month and wishes to start immediately with fewer than eight classes left in a month. For that month only a daily rate will be allowed and charged the determined amount per class. This does not apply during major holidays, school holidays, and/or when the dojo is closed.
Uniforms, equipment, promotion fees, seminars, etc. are all additional costs and are not included with tuition or registration. Siblings must be monitored and quite at all times or will be asked to leave. Parents and family members are welcome to watch classes, but must be quiet (silence all cell phones) and not disturb the students or instructors. All visitors shall stand for the opening and closing of each class during the Kajukenbo prayer time. The dojo has one restroom shared by all patrons and all users are expected to clean up after themselves after each use. We do ask that students come to class dressed and remain seated or line up in designated area prior to their scheduled class.
By signing below indicates that you have read the Waiver and Release guidelines, terms and conditions, and regulations on this contract and fully understand the contents. This contract will remain on file in the Company office unless the terms and conditions change. At that time a new contract will be executed.
